Terms of Use

01 Acceptance of Terms

By downloading or using Marmot Vox, Marmot Vault, Marmot Finder, Marmot Build, or Hera (collectively, "the Apps"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree, do not download or use the Apps.

These Terms incorporate Apple's Standard End User License Agreement (EULA), available at apple.com/legal/internet-services/itunes/dev/stdeula.

In the event of any conflict between these Terms and Apple's EULA, Apple's EULA shall govern with respect to terms specific to Apple's platform.

02 License

Marmot-Apps grants you a limited, non-exclusive, non-transferable, revocable license to use the Apps on Apple-branded devices that you own or control, subject to these Terms and the App Store Terms of Service.

You may not:

  • Copy, modify, or create derivative works of the Apps.
  • Attempt to reverse-engineer, decompile, or extract source code.
  • Distribute, sell, or sublicense the Apps to any third party.
  • Use the Apps for any unlawful, harmful, or fraudulent purpose.

03 Subscriptions & Billing

Each Marmot app offers its own optional auto-renewable subscription to unlock premium AI features. Subscriptions are per-app and are not bundled across Marmot Vox, Marmot Vault, Marmot Finder, Marmot Build, or Hera.

  • Billing: Subscriptions are billed through your Apple ID at the price shown at the time of purchase.
  • Auto-renewal: Your subscription automatically renews at the end of each period unless you cancel at least 24 hours before the renewal date.
  • Free trial: If a free trial is offered, any unused portion is forfeited upon purchase of a subscription during the trial period.
  • Cancellation: Cancel anytime via iOS Settings → [Your Name] → Subscriptions, then select the relevant Marmot app.
  • Refunds: All refund requests are handled by Apple. Visit reportaproblem.apple.com.
  • Price changes: We will notify you of any price changes before they take effect.

04 Acceptable Use

You agree to use the Apps only for lawful purposes. You must not:

  • Record conversations without the consent of all parties, where required by applicable law (Marmot Vox).
  • Scan or store documents, identification, or sensitive personal data of others without their consent (Marmot Vault, Marmot Finder).
  • Capture private spaces or property without proper authorization (Marmot Build).
  • Log, share, or otherwise process the wellness or health data of any person other than yourself without their explicit consent (Hera).
  • Use Hera's AI coaches as a substitute for diagnosis, treatment, or advice from a qualified healthcare professional (see Section 06 below).
  • Attempt to circumvent subscription restrictions or access premium features without a valid subscription.
  • Use the Apps in any way that could damage, disable, overburden, or impair our services.
  • Use AI outputs for illegal, deceptive, or harmful purposes.

05 AI Features

AI-powered features — including transcription, summaries, OCR, contextual document parsing, room reconstruction, design restaging, and wellness coaching — are provided "as-is" and may not always be accurate or complete. AI outputs should not be used as a substitute for professional medical, legal, financial, architectural, or other expert advice. You are responsible for verifying the accuracy of AI-generated content before relying on it.

By using AI features, you acknowledge that input data (audio, document images, room metadata, transcript text for rendering, or coach-message context) is transmitted to OpenAI for processing as described in our Privacy Policy. All six apps (Vox, Stage, Vault, Finder, Build, and Hera) use OpenAI under their Zero Data Retention policy.

06 Health & Wellness Disclaimer (Hera)

Hera is a wellness and lifestyle app. It is not a medical device, and it is not intended to diagnose, treat, cure, or prevent any disease or condition. Information presented by Hera — including but not limited to AI coach responses, cycle predictions, fertility-window estimates, symptom-correlation insights, BBT charts, and wellness scores — is for general informational and educational purposes only.

  • Not a substitute for professional advice. Always consult a qualified healthcare professional before making decisions about medication, contraception, fertility planning, pregnancy, menopause, mental health, exercise, or nutrition. Do not disregard or delay seeking professional medical advice because of something you read in Hera or hear from an AI coach.
  • Not for emergencies. If you are experiencing a medical emergency, call your local emergency number immediately. Hera's AI coaches are not equipped to handle emergencies.
  • Not contraception. Cycle and fertility predictions are estimates derived from the data you log. They may be inaccurate and must not be relied upon as a method of contraception or a guarantee of pregnancy.
  • Estimates, not guarantees. Predictions, scores, and recommendations are statistical estimates, not medical findings. Individual physiology varies; your data may not behave as the model expects.
  • You retain control of your data. Health data export PDFs are generated for your personal use and to share with your own healthcare providers at your discretion. We do not transmit copies to any party.

07 Intellectual Property

The Marmot-Apps name, the Marmot Vox / Vault / Finder / Build / Hera names, the marmot character, the logos, and all in-app content are the intellectual property of Marmot-Apps and are protected by copyright, trademark, and other applicable laws.

You retain full ownership of all content you create using the Apps — recordings, scans, documents, room captures, restaged renderings, cycle and symptom logs, journal entries. By using AI features, you grant us a temporary, limited license to transmit your content to third-party AI providers solely for the purpose of generating your requested output.

08 Disclaimer of Warranties

THE APPS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. MARMOT-APPS DOES NOT WARRANT THAT THE APPS WILL BE UNINTERRUPTED, ERROR-FREE, VIRUS-FREE, OR THAT ANY DEFECTS WILL BE CORRECTED.

09 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MARMOT-APPS AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF RECORDINGS, LOSS OF SCANS, LOSS OF REVENUE, OR LOSS OF PROFITS — ARISING OUT OF OR RELATED TO YOUR USE OR INABILITY TO USE THE APPS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

10 Governing Law

These Terms shall be governed by and construed in accordance with applicable law. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of competent courts. Nothing in this section limits your rights as a consumer under applicable mandatory local law.

11 Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via the Apps or this website and update the "Last updated" date above. Continued use of the Apps after changes constitutes acceptance of the revised Terms.
